The Virginia Supreme Court reversed and dismissed convictions
for robbery and use of a firearm against Mr. Turpin’s
client.
Upon appeal of convictions for robbery and use of a firearm
in the commission of robbery, the Virginia Supreme Court agreed
with Mr. Turpin that the Commonwealth had not proven a robbery
against the alleged victim. The evidence was insufficient
to establish that the alleged individual victim was intimidated,
or that any property had been taken from him personally. Accordingly,
the convictions for robbery and use of a firearm were reversed
and dismissed.
